Five years after DiCaro, Coppo & Popcke took the Kibler v. Northern Inyo case to the California Supreme Court and convinced the Court to re-write the law pertaining to the legal protections afforded to doctors conducting peer review, DCP has done it again. Partners Carlo Coppo and Mike Popcke and Associate Shelley Carder persuaded the appellate court in San Francisco to overrule the trial court and grant a dispositive motion in favor of DCP’s hospital client. The unpublished appellate opinion relied on Kibler and subsequent, related cases in deeming the physicians’ conduct to be part of the peer review process and consequently protected as such.
